En una economia moderna, com l\u2019andorrana, s\u2019evidencia cada vegada m\u00e9s la necessitat d\u2019aquesta eina. Els precedents reeixits de Fran\u00e7a, des del 1855 i Espanya a partir de 1861 feien que les institucions s\u2019interessin per la q\u00fcesti\u00f3.<\/p>\n<p>Si b\u00e9 actualment el cadastre comunal compleix amb part de les funcions del registre, doncs indica qui \u00e9s el propietari, de qui es presumeix que posseeix aquell b\u00e9, les funcions del registre s\u00f3n moltes altres.<\/p>\n<p>Aix\u00ed, a part d\u2019indicar qui \u00e9s el propietari de la finca, el registre indica tamb\u00e9 quines c\u00e0rregues pesen sobre aquell b\u00e9 i quin ordre de prefer\u00e8ncia tenen unes c\u00e0rregues sobre altres. Val a dir que aquest element clarificador, \u00e9s especialment necessari perqu\u00e8 ara mateix, a Andorra poden embargar un b\u00e9 el saig i el batlle i de fet, un mateix b\u00e9 pot estar embargat per tots dos, sense que un conegui que l\u2019altre l\u2019ha embargat. D\u2019altra banda, el registre permet tamb\u00e9 d\u2019individualitzar les c\u00e0rregues sobre cada finca i evita aix\u00ed les hipoteques solid\u00e0ries entre diverses propietats. Cal recordar que aquest fou un dels motius pel que s\u2019aprov\u00e0 el decret de l\u20191 de maig de 1922 que preveia la creaci\u00f3 d\u2019un registre de la propietat amb 6 llibres, un per cada com\u00fa.<\/p>\n<p>Per tant, el Registre de la Propietat al donar a con\u00e8ixer el propietari i les c\u00e0rregues, afavoreix la seguretat jur\u00eddica, per\u00f2 a m\u00e9s a m\u00e9s, al permetre individualitzar les c\u00e0rregues que pesen sobre cada finca, afavoreix el tr\u00e0fic mercantil.<\/p>\n<p>En els pa\u00efsos del nostre entorn, l\u2019acc\u00e9s a les dades del registre de la propietat \u00e9s p\u00fablic per qui hi tingui un inter\u00e8s leg\u00edtim. Per suposat que la idiosincr\u00e0sia del pa\u00eds no ha de permetre un acc\u00e9s tant important com el que es produeix en el nostre entorn i que aquest inter\u00e8s leg\u00edtim es pot limitar al propietari i al titular de drets sobre la finca. D\u2019altra banda, cal recordar que enregistrar una propietat \u00e9s un acte voluntari i que addicionalment les dades respecte a la titularitat les t\u00e9 cada com\u00fa en el seu cadastre.<\/p>\n<p>Finalment, cal tenir en compte que tractant-se d\u2019una nova creaci\u00f3, per funcionar el m\u00e9s correctament possible, \u00e9s convenient que el registre estigui coordinat amb el cadastre, per tal que les descripcions de cada propietat es corresponguin des d\u2019un inici completament amb la realitat de cada finca, superf\u00edcie i l\u00edmits.<br \/>\nEn qualsevol cas, la modernitat, la seguretat jur\u00eddica que demanen cada vegada m\u00e9s els ciutadans andorrans i tamb\u00e9 els inversors estrangers fan molt convenient si no imprescindible que es posi en funcionament un registre de la propietat. Per suposat, i degut a la mida del nostre pa\u00eds, al front del registre hi ha d\u2019haver un notari, no tenint massa sentit crear un nou cos de funcionaris per atendre el registre.<\/p>\n<p>Certament, crear un registre i la legislaci\u00f3 corresponent no \u00e9s f\u00e0cil. Cal un estudi pausat, estudi que ja est\u00e0 en marxa per part d\u2019algunes institucions i que confiem que pugui debatre el Consell General d\u2019aqu\u00ed pocs anys.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e221a27 elementor-widget elementor-widget-text-editor\" data-id=\"e221a27\"
